IPC Section 507. Criminal intimidation by an anonymous communication

Whoever commits the offence of criminal intimidation by an anonymous communication, or having taken precaution to conceal the name or abode of the person from whom the threat comes, shall be punished with imprisonment of either description for a term which may extend to two years, in addition to the punishment provided for the offence by the last preceding section.

Obtaining money under a threat of divine punishment is not punishable as the offender cannot himself inflict the threatened punishment nor can he cause it to be inflicted.

The section contemplates commission of criminal intimidation by the offender. He must commit criminal intimidation if either by an anonymous communication or having taken precaution to conceal the name or abode of the person who gives the threat. It is not necessary that both name and abode must be concealed because the word ‘or’ and not ‘and’ has been used between the words ‘name’ and ‘abode’.

भारतीय दंड संहिता की धारा 507 के अनुसार, जो भी कोई अनाम संसूचना द्वारा या उस व्यक्ति का, जिसने धमकी दी हो, नाम या निवास-स्थान छिपाने का पूर्वोपाय करके आपराधिक अभित्रास का अपराध करेगा, तो उसे इस अपराध के लिए पूर्ववर्ती धारा 506 में उपबन्धित दण्ड के अतिरिक्त किसी एक अवधि के लिए कारावास जिसे दो वर्ष तक बढ़ाया जा सकता है से दण्डित किया जाएगा ।

यह एक जमानती, गैर-संज्ञेय अपराध है और प्रथम श्रेणी के मेजिस्ट्रेट द्वारा विचारणीय है।

यह समझौता करने योग्य नहीं है।

दैवीय दंड की धमकी के तहत धन प्राप्त करना दंडनीय नहीं है क्योंकि अपराधी स्वयं धमकी की सजा नहीं दे सकता है और न ही वह इसे भड़का सकता है।

धारा अपराधी द्वारा आपराधिक धमकी देने पर विचार करती है। यदि किसी अज्ञात संचार द्वारा या धमकी देने वाले व्यक्ति के नाम या निवास को छिपाने के लिए सावधानी बरतते हुए उसे आपराधिक धमकी देनी चाहिए। यह आवश्यक नहीं है कि नाम और निवास दोनों को ही छिपाया जाए क्योंकि 'या' और 'और' शब्द का प्रयोग 'नाम' और 'निवास' शब्दों के बीच किया गया है।
