📊 Phase 4 Analysis (Sec. 147-177)
This phase highlights the modernization of State and Public order laws:
- End of "Sedition": The term "Sedition" has been removed. Section 152 BNS now targets acts that "endanger sovereignty, unity and integrity of India" without the colonial baggage of disaffection towards the government.
- Financial Crimes against State: Section 147 now explicitly includes waging war through financial means (funding).
- Assembly and Rioting: These have been consolidated into Section 189 and 191 respectively, making the procedural application clearer.
Section 152: Covers secession, armed rebellion, subversive activities, and separatist activities.
Vicarious Liability: Old IPC 149 is now BNS 190, retaining the principle that every member of an assembly is liable for crimes committed in prosecution of a common object.
