Matrimonial Disputes: If allegations are found to be false


The Delhi High Court has observed in a matrimonial dispute that if the allegations are found to be false, the trial court will take necessary steps to prosecute the complainant concerned.

A bench of Justice Bakhru has passed the order on 25.09.2019 in the case named SAMEER GARG & ANR vs STATE & ANR.



The petitioners have filed the present petition, inter alia, praying that FIR No.270 / 2019 has been registered with PS Ashok Vihar under Section 506/354 (B) / 509/452/342 and In addition, all other results arising should be canceled.

The High Court stated that "the relief sought by the petitioners cannot be granted, as some offenses are alleged against the petitioners".

The High Court then noted "However, it appears that there are marital disputes which have taken an ugly turn. This Court expects that the investigating agencies will conduct a fair investigation and present a status report before the trial court".

The High Court also said that "it is also necessary to see that if any of the allegations are found to be misconceived, the trial court will take necessary steps to prosecute the complainant concerned to the fullest extent of the law"
